CRIMINALIDADE ORGANIZADA E JUSTIÇA PENAL NEGOCIADA: DELAÇÃO PREMIADA.

Em busca da relação profícua entre Psicanálise e História, procura-se, neste artigo avaliar como Carlo Ginzburg, em sua trajetória intelectual e acadêmica, discutiu Freud e a Psicanálise à luz da Micro-História. Para tanto, a obra de Ginzburg Mitos, emblemas, sinais: morfologia e história tornou-se um manancial para esta busca. Nos capítulos Sinais: raízes de um paradigma indiciário e, principalmente, Freud, o homem dos lobos e os lobisomens, Ginzburg discute criticamente as interpretações de Freud sobre o seu caso clínico mais importante, (...) um paciente russo de nome Serguei Constantinovitch Pankejeff, conhecido como O Homem dos Lobos. Ginzburg não deixa de reconhecer a magnitude da obra de Freud, mas aponta suas limitações como não considerar suficientemente a formação cultural de seu paciente e dar um enfoque maior a individuação. Ginzburg permitiu, ainda, demonstrar em sua obra a importância da Psicanálise na elaboração do conceito fundamental à MicroHistória, o paradigma indiciário. (shrink)

Totalidade dialética: contribuições para derruir os limites entre a filosofia e a interdisciplinaridade Resumo: O presente artigo busca trazer para o debate alguns elementos que denotam uma tendência na filosofia de ser uma atividade intelectual voltada para a construção de um olhar de unidade objetivando a totalidade. A categoria totalidade primeiro aparece como objetivo do processo gnosiológico para em seguida aparecer como categoria lógica e epistemológica, sendo significante e explicativa. Esta tendência da filosofia ainda colocaria em suspeição a ideia de (...) interdisciplinaridade como pensamento inovador fundado na década de sessenta na França. Este trabalho ainda busca contribuir com o debate interdisciplinar ao colocar a pertinência da visão unitária, sistêmica e dialética, que nos conduza para uma superação do que podemos chamar de “alienação esclarecida”. Dialetic totality: contributions to drop the limits between philosophy and interdisciplinarity Abstract: This article seeks to bring to the debate some elements that denote a tendency in philosophy to be an intellectual activity aimed at building a look of unity aiming at totality. The totality category first appears in history as the objective of the gnosiological process and then appears as a logical and epistemological category, being significant and explanatory. This trend in philosophy would still put the idea of interdisciplinarity as an innovative thought founded in the sixties in France under suspicion. This work still seeks to contribute to the interdisciplinary debate by placing the pertinence of the unitary, systemic and dialectical view, which leads us to overcome what we can call "enlightened alienation". Este artigo propõe-se a discutir, sob o paradigma do Estado Democrático de Direito, em que medida a aplicação da cota de gênero contribui para fomentar a representatividade feminina na política. Utilizam-se a pesquisa bibliográfica e o método jurídico-dedutivo. Os resultados sinalizam que não há uma correlação necessária entre o preenchimento da cota de gênero e o incremento do número de candidatas eleitas. Os resultados apontam que a superação dessa desigualdade requer a discussão de outras possibilidades, tais como reserva de vagas (...) no Legislativo, combate às candidaturas femininas fictícias e aplicação obrigatória de recursos nas campanhas femininas. This paper focuses on Gilberto Gomes’ work on free will. In a series of contributions that have had a significant impact on the respective literature, Gomes developed a conception about free will and argued that its existence is consistent with recent scientific findings, specially in neuroscience. In this paper, I object to a claim of Gomes about his conception of free will, namely the claim that it is a compatibilist conception. I seek to show that Gomes (...) does not use the term ‘compatibilism’ as it is usual in the contemporary literature on free will, i.e., as the thesis that free will can exist even if determinism is true. Moreover, the conception of free will Gomes proposes actually has an incompatibilist commitment. I argue that, more than a mere terminological point, acknowledging the incompatibilist aspect of Gomes’ view motivates important questions about the details of the view and helps to reveal a limitation of his defense of the existence of free will. [Este artigo tem como tema o trabalho de Gilberto Gomes sobre o livre-arbítrio. Em uma série de contribuições que tiveram um impacto significativo na respectiva literatura, Gomes elaborou uma concepção sobre o livre-arbítrio e argumentou que sua existência é consistente com descobertas científicas recentes, especialmente na neurociência. Neste artigo, questiono uma afirmação de Gomes sobre sua concepção sobre o livre-arbítrio, a saber, que se trata de uma concepção compatibilista. Busco mostrar que Gomes não usa o termo ‘compatibilismo’ como é habitual na literatura contemporânea sobre o livre-arbítrio, isto é, como a tese segundo a qual o livre-arbítrio pode existir ainda que o determinismo seja verdadeiro. Ademais, a concepção sobre o livre-arbítrio desenvolvida por Gomes tem, efetivamente, um compromisso incompatibilista. Argumento que, mais do que uma mera elucidação terminológica, reconhecer o elemento incompatibilista presente na proposta de Gomes suscita questões importantes sobre os detalhes da proposta e também ajuda a reconhecer uma limitação de sua defesa da existência do livre-arbítrio.]. Several countries maintain universal health coverage, which implies responsibility to organize delivery formats of healthcare services and products for citizens. In Brazil, the health system has a principle of universal access for more than 30 years, but many deficiencies remain and the country observes a day practice for those seeking judicial decisions to determine provision of healthcare.

Background: The new human coronavirus that leads to COVID-19 has spread rapidly around the world and has a high degree of lethality. In more severe cases, patients remain hospitalized for several days under treatment of the health team. Thus, it is important to develop and use technologies with the aim to strengthen conventional therapy by encouraging movement, physical activity, and improving cardiorespiratory fitness for patients. In this sense, therapies for exposure to virtual reality are promising and have been shown to (...) be an adequate and equivalent alternative to conventional exercise programs.Aim: This is a study protocol with the aim of comparing the conventional physical therapy intervention with the use of a non-immersive VR software during COVID-19 hospitalization.Methods: Fifty patients hospitalized with confirmed diagnosis of COVID-19 will be divided in two groups under physiotherapy treatment using conventional or VR intervention: Group A: participants with COVID-19 will start the first day of the protocol with VR tasks in the morning and then in the second period, in the afternoon, will perform the conventional exercises and Group B: participants with COVID-19 will start the first day with conventional exercises in the morning and in the second period, in the afternoon, will perform activity with VR. All participants will be evaluated with different motor and physiologic scales before and after the treatment to measure improvements.Conclusion: Considering the importance of benefits from physical activity during hospitalization, VR software shows promise as a potential mechanism for improving physical activity. The scientific community has debated the importance of “return” activities after ethnobiological studies. This issue has provoked debate because it touches on the ethics of research and the relationships with the people involved in these studies. This case study aimed to investigate community perception of an ethnobotany research project that was carried out in the semi-arid region of northeastern Brazil. Furthermore, we reported how the residents of this rural community felt about participating in the activities of “return” that arose from (...) the projects. Our findings demonstrate that “return” activities should be planned from the design phase of the research until its closure as a lifelong process that allows the communities involved to gradually take ownership of the information and actions that are being generated. Similarly, we argue that such activities must be negotiated with the people of the community so that they have decision-making power and autonomy to decide what is most relevant to their lives. While agreeing with Fischborn’s (2018) contention that, according to one traditional definition of compatibilism, my position should be classified as that of a libertarian incompatibilist, I argue here for a different view of compatibilism. This view involves, on the one hand, local probabilistic causation of decisions (rather than universal strict determinism) and, on the other, free will conceived as involving decisions generated by a decision-making process carried out by the brain, which consciously contemplates different alternatives and could in principle have (...) been different from what it was, implying that the agent could in normal conditions have done otherwise in the same circumstances. After discussing different views of causation (including determinism) and of free will, I make a revision of some passages from my earlier work, quoted by Fischborn. I conclude that what is crucial in the question of (in)compatibilism is the (in)compatibility between freedom of decisions and natural causation of human actions. According to this looser and, I argue, more pertinent view of compatibilism, I maintain my previous classification of my position on the matter as compatibilist. (shrink)

No cinema brasileiro recente, o diálogo entre o documentário e a ficção tem merecido destaque, com produções de baixo orçamento e ideias originais. É o caso de Santiago (João Moreira Salles, 2007) e Viajo Porque Preciso, Volto Porque Te Amo (Marcelo Gomes, Karim Aïnouz, 2009), filmes que trabalham esse diálogo de forma sutil e diegética, ressignificando imagens de um arquivo próprio, pessoal.

O objetivo do estudo é analisar a série De onde vem? , a qual introduz o conhecimento científico na infância, identificando aspectos que justifiquem o seu emprego como um recurso pedagógico adequado para a introdução de conceitos de Ciência de forma lúdica e dinâmica na infância. Os resultados apresentam aspectos gerais dos episódios da Série, além da descrição estrutural dos episódios de forma generalizada de acordo com as categorias sugeridas por Gomes (2008). A Série introduz conceitos científicos, presentes no (...) cotidiano, por meio de uma linguagem adequada à compreensão infantil, tornando, assim, este material uma importante alternativa de apoio ao professor do Ensino Fundamental para a introdução da ciência na infância. Despite being fairly powerful, finite non-deterministic matrices are unable to characterize some logics of formal inconsistency, such as those found between mbCcl and Cila. In order to overcome this limitation, we propose here restricted non-deterministic matrices (in short, RNmatrices), which are non-deterministic algebras together with a subset of the set of valuations. This allows us to characterize not only mbCcl and Cila (which is equivalent, up to language, to da Costa's logic C_1) but the whole hierarchy of da Costa's calculi (...) C_n. This produces a novel decision procedure for these logics. Moreover, we show that the RNmatrix semantics proposed here induces naturally a labelled tableau system for each C_n, which constitutes another decision procedure for these logics. This new semantics allows us to conceive da Costa's hierarchy of C-systems as a family of (non deterministically) (n+2)-valued logics, where n is the number of "inconsistently true" truth-values and 2 is the number of "classical" or "consistent" truth-values, for every C_n. Trying to overcome Dugundji’s result on uncharacterisability of modal logics by finite logical matrices, Kearns and Ivlev proposed, independently, a characterisation of some modal systems by means of four-valued multivalued truth-functions , as an alternative to Kripke semantics. This constitutes an antecedent of the non-deterministic matrices introduced by Avron and Lev . In this paper we propose a reconstruction of Kearns’s and Ivlev’s results in a uniform way, obtaining an extension to another modal systems. The first part of the paper (...) is devoted to four-valued Nmatrices, including Kearns’s and Ivlev’s. Besides proving with full details Kearns’s results for T, S4 and S5, we also obtain a characterisation of the system B by four-valued Nmatrices with level valuations. In the first part of this paper we analyzed finite non-deterministic matrix semantics for propositional non-normal modal logics as an alternative to the standard Kripke possible world semantics. This kind of modal system characterized by finite non-deterministic matrices was originally proposed by Ju. Ivlev in the 70s. The aim of this second paper is to introduce a formal non-deterministic semantical framework for the quantified versions of some Ivlev-like non-normal modal logics. It will be shown that several well-known controversial issues of (...) quantified modal logics, relative to the identity predicate, Barcan’s formulas and de re and de dicto modalities, can be tackled from a new angle within the present framework. The aim of this article is to explore the class of intermediate logics between the truth-preserving Lukasiewicz logic L and its degree-preserving companion L<⁠. From a syntactical point of view, we introduce some families of inference rules (that generalize the explosion rule) that are admissible in L< and derivable in L and we characterize the corresponding intermediate logics. From a semantical point of view, we first consider the family of logics characterized by matrices defined by lattice filters in ⁠[0,1], but (...) we show there are intermediate logics falling outside this family. Finally, we study the case of finite-valued Lukasiewicz logics where we axiomatize a large family of intermediate logics defined by families of matrices (A,F) such that A is a finite MV-algebra and F is a lattice filter. The 3-valued paraconsistent logic Ciore was developed by Carnielli, Marcos and de Amo under the name LFI2, in the study of inconsistent databases from the point of view of logics of formal inconsistency (LFIs). They also considered a first-order version of Ciore called LFI2*. The logic Ciore enjoys extreme features concerning propagation and retropropagation of the consistency operator: a formula is consistent if and only if some of its subformulas is consistent. In addition, Ciore is algebraizable in the sense of (...) Blok and Pigozzi. On the other hand, the logic LFI2* satisfies a somewhat counter-intuitive property: the universal and the existential quantifier are inter-definable by means of the paraconsistent negation, as it happens in classical first-order logic with respect to the classical negation. This feature seems to be unnatural, given that both quantifiers have the classical meaning in LFI2*, and that this logic does not satisfy the De Morgan laws with respect to its paraconsistent negation. The first goal of the present article is to introduce a first-order version of Ciore (which we call QCiore) preserving the spirit of Ciore, that is, without introducing unexpected relationships between the quantifiers. The second goal of the article is to adapt to QCiore the partial structures semantics for the first-order paraconsistent logic LPT1 introduced by Coniglio and Silvestrini, which generalizes the semantic notion of quasi-truth considered by Mikeberg, da Costa and Chuaqui. Finally, some important results of classical Model Theory are obtained for this logic, such as Robinson’s joint consistency theorem, amalgamation and interpolation. Although we focus on QCiore, this framework can be adapted to other 3-valued first-order LFIs. (shrink)

The contemporary debate on the ethics of cognitive enhancement has mainly focused on the question whether, and to which extent, individuals should be granted the right to make use of new technologies in order to enhance their own cognitive powers. The question on the existence of a duty to implement the cognitive enhancement of the individuals has received less attention. In this paper, I argue that the state has a prima facie duty to pursue the cognitive enhancement of its citizens. (...) The argument involves an analysis of the so-called effect Flynn and of the public policies for the education of gifted children. The duty the state has to further the cognitive enhancement of its citizens is qualified by our knowledge of the efficacy and the safety of the procedures used for cognitive enhancement. (shrink)

A partir de uma meta-análise filosófica, procura-se explicitar as intenções não aparentes de Freud com sua análise do termo Unheimliche. Determinadas particularidades da abordagem freudiana são observadas desvendando relações estéticas na construção de sentido do espírito próprio da psicanálise. Uma eventual aproximação dialética com a Teoria Crítica ajudará a identificar, nesse jogo de relações, a importância de conteúdos marginalizados pela história do conhecimento que são revitalizados por (...) Knowlson nous a donné un des livres les plus complets, jusqu'à présent, sur l'histoire de l'idée d'une langue universelle. Dans cette étude critique, cet ouvrage est analysé en détail. Parmi ses mérites, on souligne l'usage de matériaux inédits , et l'effort pour élargir l'horizon de la recherche sur cette idée, en essayant de l'identifier non seulement dans une ou deux disciplines , mais dans un contexte culturel plus général. D'autre part, on critique l'absence d'une sensibilité plus aigüe pour l'analyse des (...) "transformations" que l'idée a pu subir au cours des 17éme et 18éme siécle, ainsi que pour les nuances d'opinions - souvent décisives - parmi des auteurs qui appartiennent au même groupe. (shrink)

The contemporary theological discourse is still understood as something restricted to the ecclesiastical and clerical ambit. Nevertheless, the theologian's task to use new languages to reach new fields and ease the dialogue still remains. It is observed as even more complex in a plural scene as the present days. For this reason, the narrative, as a theological language, presents a reading key to Christology, used by the contemporary french theologian, Joseph Moingt. Through this key, it is supposed to give a (...) relevant and convincing answer to the question repeated all the time: who is Jesus of Nazareth and what he means for our relationship with God? O texto procura problematizar o conceito de poder constituinte segundo a leitura das revolutions modernes empreendida por H. Arendt. Procura-se reconstruir o quadro histórico da autora desenvolvido na obra On revolution seguindo o desdobramento do conceito de poder constituinte nas analises de Jacques Derrida e Antonio Negri.
